Municipal Law

Eminent domain – condemnation – is a highly technical area of law that presents unique challenges. The eminent domain attorneys at Lounsbery Ferguson Altona & Peak are specialists who can provide expert guidance to public sector clients. This assistance extends to defense against inverse condemnation claims.


The attorneys in the LFAP Land group provide legal services covering the entire development cycle, including acquisition/sale, title review, environmental compliance, project entitlement, and dispute resolution.

Land Use 

In today’s environment, most large projects face opposition and none are approved without meticulous CEQA review. The cost and delay of an overly broad environmental review can kill a project, but an inadequate CEQA review will leave a public agency vulnerable and subject to challenge.

Helen Holmes Peak practices in the area of municipal law and government relations. She has represented numerous public agencies in transactional and litigation matters in a variety of practice areas, including general municipal, land use, environmental, eminent domain, real estate transactional, elections, public contracting, and employment and personnel matters. In connection with her representation, Ms. Peak has participated in negotiations with, and hearings before, various local and state regulatory and permitting agencies. She served as Corporation Counsel of the entity formerly known as Centre City Development Corporation in San Diego. Ms. Peak currently serves as the contract City Attorney for San Marcos.

Ms. Peak received an undergraduate degree in political science from Stanford University and received her Juris Doctor degree from McGeorge School of Law, University of the Pacific.

She is a member of the City Attorneys Association of San Diego (past President, 2004-2005 and 2017-2018).  Ms. Peak has served on the Legal Advocacy Committee of the League of California Cities (2007-2009, Chair 2008-2009), and the City Attorney Department Post-Redevelopment Working Group.  She is currently a member of the City Attorney Department Attorney Development and Succession Committee (2017 – 2023).  Ms. Peak served for many years as a member of the Board of Directors of the Camp Pendleton Armed Services YMCA (1985-2019), twice having served as Board Chair. She is a member of the State Bar of California, the San Diego County Bar Association and the U.S. Supreme Court Bar.
